These Terms cover what you can expect from us and what we ask of you when you use eViRis Health. They apply to our website, app, and all services we provide. Please take a few minutes to read them — they're written to be straightforward, not buried in fine print.

This document is an electronic record in terms of the Information Technology Act, 2000 and the rules thereunder. It is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, which requires publishing the rules, regulations, privacy policy, and terms for access or usage of our website and mobile application. By using our platform or services, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all other applicable policies incorporated herein by reference.

1. About these Terms

These Terms of Service cover what you can expect from us and what we ask of you when you use eViRis Health. They apply to our website, app, and all services we provide. By using eViRis Health — whether browsing, placing an order, or booking a service — you're agreeing to these Terms. If something here doesn't sit right with you, please don't use our services, and feel free to reach out if you have questions.

Use of our platform is offered subject to acceptance of all the terms, conditions, and notices contained here, along with our Privacy Policy, Refund Policy, and any other applicable policies incorporated by reference. We may update these Terms from time to time at our sole discretion; changes are effective immediately upon posting on our website. Your continued use of the platform confirms your acceptance of any changes, so please review these Terms periodically.

Our services are provided in compliance with the laws of India. We do not deliver products or provide services outside India. If you access our services from outside India, you do so at your own risk and are responsible for compliance with applicable local laws.

2. Who can use eViRis Health

You need to be legally old enough to enter into a contract under Indian law. Use of our platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" — including minors and un-discharged insolvents — are not eligible to use our services directly.

If you're under 18, a parent or guardian will need to use the platform on your behalf and accept these Terms for you. By accessing and using this platform, you represent that you are of legal age to form a binding contract and are not barred from entering into one under the laws of India.

We reserve the right to refuse access to any user, or to terminate access granted to existing users, at any time and for any valid reason — including discovery that a user is under 18 and using the platform without a guardian's involvement.

3. What we offer

eViRis Health gives you access to pharmacy delivery, home diagnostics, and home nursing care. A few things worth keeping in mind when you use us:

  • We're not a replacement for emergency care — if it's urgent, please call emergency services.
  • The more accurate the health information you share with us, the better we can serve you.
  • Healthcare outcomes depend on many factors — we can't guarantee specific results.
  • Please follow the guidance of the healthcare professionals involved in your care.

4. Platform role & third-party services

eViRis Health is a technology and service coordination platform — a marketplace that connects you with independent third-party providers. eViRis Health itself does not manufacture medicines, operate laboratories, or employ the nurses and technicians who visit your home.

When you place an order or book a service through our platform, the contract for that service is directly between you and the relevant third-party provider. eViRis Health's role is limited to facilitating the connection and coordinating the fulfilment. Product availability, quality of service, timelines, and statutory compliance remain the responsibility of the respective provider, subject to applicable law.

Licensed pharmacies

Registered retail pharmacies that dispense your medication orders under the supervision of a registered pharmacist, as required under the Pharmacy Act, 1948.

Diagnostic laboratories

Accredited labs that conduct your tests, generate and validate results, and (through their phlebotomists) collect samples at home.

Nursing service partners

Partner organisations that engage the qualified nurses, phlebotomists, and technicians who visit your home for nursing and sample-collection appointments.

Logistics partners

Delivery partners who physically transport your orders from the pharmacy or lab to your address.

Payment service providers

PCI-DSS-compliant payment gateways and aggregators that process your transactions securely. We do not store your full card numbers.

All third-party providers on our platform are required to comply with applicable laws and are governed by separate Partner Terms and Service Level Agreements with eViRis Health. If you experience any issue with a provider's service, please reach out to us at hello@evirishealth.com and we will do our best to help.

5. Prescription medications & scheduled drugs

The dispensing of prescription medications through our platform is governed by the Drugs and Cosmetics Act, 1940 and the Drugs and Cosmetics Rules, 1945. Here's what you need to know:

  • Schedule H and H1 drugs require a valid prescription from a registered medical practitioner. A valid prescription must include the doctor's name and registration number, patient name, date, and the drug name, dosage, and duration. We will ask you to upload a clear photograph or scan of the original prescription before your order is processed.
  • Schedule H1 drugs — which include certain high-risk antibiotic classes such as fluoroquinolones, third-generation cephalosporins, carbapenems, and specified antivirals — are subject to additional review by our pharmacist partners in accordance with applicable regulatory guidelines.
  • Schedule X drugs (certain psychotropic and narcotic substances regulated under the Narcotic Drugs and Psychotropic Substances Act, 1985) are not available through our platform under any circumstances, in line with Rule 65-A of the Drugs and Cosmetics Rules, 1945.
  • All dispensing is performed by registered pharmacists holding valid licences under the Pharmacy Act, 1948. Prescription records are retained by our pharmacy partners in accordance with Rules 64 and 65 of the Drugs and Cosmetics Rules, 1945.
  • Substitution of a prescribed drug with an equivalent generic is only processed if your doctor has permitted it, or if the prescription lists the active pharmaceutical ingredient (salt name) instead of a specific brand. In the absence of such permission, the pharmacy partner will not dispense a substitute. Your consent is always obtained before any substitution is made.

Drug information shown on our platform — such as dosage, indications, and side effects — is for general reference only and is not a substitute for advice from your treating doctor or pharmacist. Please always follow their guidance for your specific health situation.

Uploading a forged or false prescription is a criminal offence under the Drugs and Cosmetics Act, 1940 and may result in immediate account termination and referral to law enforcement.

6. Ordering & delivery

When ordering medications or booking services through our platform:

  • You must provide a valid prescription for all prescription medications.
  • You agree to pay the prices displayed at the time of placing your order.
  • Product listings on our platform are an invitation to offer, not an offer for sale. Your order constitutes an offer, which is accepted by the relevant pharmacy partner only after prescription validation and stock confirmation.
  • Delivery timelines are estimates and may vary based on your location and stock availability.
  • You are responsible for ensuring someone is available to receive the delivery.
  • If your prescription is found to be invalid or incomplete after an order is placed, the order will not be processed. Any payment already made will be refunded in line with our Refund Policy.

7. Pricing & payment

We strive to provide you with the best prices possible on the products and services you need. The following applies to all purchases made through our platform:

  • Commercial terms such as price, delivery, and dispatch are set on a principal-to-principal basis between you and the fulfilling pharmacy or service partner. eViRis Health may levy a platform fee, delivery charge, or other applicable fees — always shown in the Bill Summary before you place your order.
  • Payments are processed through PCI-DSS-compliant payment gateways and aggregators. We do not store your full card numbers or net-banking credentials.
  • All prices are in Indian Rupees and are exclusive of applicable taxes unless stated otherwise. Applicable taxes are added at checkout.
  • You confirm that you are the authorised holder of the payment instrument used in any transaction on our platform.
  • Refunds, where applicable, are made in Indian Rupees to the original payment method, in accordance with our Refund Policy.
  • We reserve the right to refuse to process orders from users with a prior history of questionable charges or breach of these Terms.

Payments are processed through PCI-DSS-compliant payment gateways and aggregators that are beyond our direct control. We are not responsible for any loss or damage caused during the payment process by these banks, gateways, or aggregators. Please review the final Bill Summary displayed in your cart before placing your order for a detailed breakdown of all applicable charges.

8. Cancellations & returns

Our full cancellation and return conditions are set out in our Refund Policy. The key points are:

  • Medication orders can be cancelled before they are dispatched from the pharmacy. Once dispatched, cancellations are subject to the pharmacy partner's applicable return policy.
  • Opened, used, or partially consumed medications cannot generally be returned, for patient safety and hygiene reasons.
  • Schedule H, H1, and temperature-sensitive medications are non-returnable once delivered, unless there is a quality defect or a fulfilment error on our part.
  • For home nursing and diagnostic appointments, you may cancel or reschedule at no charge up to 2 hours before the scheduled visit. Cancellations made within 2 hours of the appointment may attract a cancellation fee, communicated at the time of booking.
  • If a nurse or technician cannot attend for reasons within our control, we will reschedule your appointment at no additional cost or issue a full refund — whichever you prefer.

9. Medical disclaimer

Information provided through our website or app is for general healthcare support and does not replace professional medical judgment. Our services are not intended for emergency care. For emergencies, please contact local emergency services immediately.

You are responsible for consulting qualified medical professionals and for using medicines only as prescribed. eViRis Health does not guarantee clinical outcomes. Content on our platform — including text, articles, drug information, and graphics — is for general information purposes only and does not constitute medical advice, diagnosis, treatment, or recommendation of any kind. It should not be relied upon as a substitute for sound professional medical advice from your doctor.

Risks of using our services

As with any healthcare service, there are potential risks. Medical professionals you consult through our platform do not examine you physically and may not have access to your complete medical history. The advice or opinion you receive could be limited and provisional, and is not intended to replace a face-to-face visit with a physician or an actual doctor-patient relationship. We strongly encourage you to stay in touch with an on-ground physician and share any online opinion with them. In case of a difference of opinion, you bear the responsibility of deciding on consultation or treatment. Any information you provide that is falsified, misleading, or incomplete will render the opinion and all details therein null and void.

10. Home nursing & diagnostic services

Home nursing and diagnostic services are delivered by third-party partner organisations who engage qualified and trained professionals. The nurses, phlebotomists, and technicians who visit your home are employed or contracted by these partner organisations — not by eViRis Health directly. Clinical judgment during a home visit remains with the attending professional and, ultimately, with your treating doctor.

Diagnostic test results are generated and validated by our accredited laboratory partners. Results are shared for informational purposes and should be reviewed and interpreted by a qualified clinician in the context of your full medical history. eViRis Health does not independently validate test results and is not responsible for clinical decisions made based on those results.

11. Adverse drug reactions

If you experience an unexpected or adverse reaction to any medication received through our platform, please seek medical attention immediately and let your doctor know. We also ask you to report the reaction to us at hello@evirishealth.com — this allows us to document the incident and, where required, report it through the Pharmacovigilance Programme of India (PvPI), which is run by the Indian Pharmacopoeia Commission under the Central Drugs Standard Control Organisation (CDSCO).

Reporting adverse drug reactions helps protect other patients and supports national drug safety monitoring. Every report matters.

12. Your account

Some features require you to create an account. When you do, you're responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Providing accurate and up-to-date information.
  • Immediately notifying us of any unauthorised use of your account or any other security breach.
  • Logging out at the end of each session, especially on shared devices.

If an account is being used in a way that violates these Terms, we may suspend or close it. We cannot and will not be liable for any loss or damage arising from your failure to keep your account information secure and confidential. 13. Acceptable use

You agree not to:

  • Use the platform for unlawful, fraudulent, or misleading activity.
  • Upload false, forged, or invalid prescriptions or medical records.
  • Interfere with platform security, availability, or integrity.
  • Attempt unauthorised access to accounts, systems, or data.
  • Sell, trade, or otherwise transfer your account to another party.
  • Create more than one active account on the platform.

Uploading a forged or false prescription is a criminal offence under the Drugs and Cosmetics Act, 1940 and may result in immediate account termination and referral to law enforcement.

14. Intellectual property

All platform content, trademarks, branding, design, software, databases, and related materials are owned by or licensed to eViRis Health and are protected under applicable intellectual property laws. The trademarks, logos, and service marks displayed on our platform are the property of eViRis Health or their respective third-party partners. You are not permitted to use them without prior consent.

You receive a limited, non-exclusive, revocable licence to access and use the platform for personal, lawful purposes only. Except as expressly provided here, you shall not copy, republish, post, display, translate, transmit, reproduce, or distribute any content through any medium without obtaining the necessary authorisation from eViRis Health or the relevant third-party owner.

15. No guarantees & disclaimers

We work hard to keep things running smoothly, but we can't promise the platform will always be available or entirely free from technical issues. Our services are offered on an "as-is" and "as-available" basis, without warranties of any kind — express, implied, statutory, or otherwise — to the maximum extent permitted by applicable law. This includes implied warranties of title, non-infringement, merchantability, or fitness for a particular purpose.

We make no warranty that the platform or services will meet your requirements, or that your use will be uninterrupted, timely, secure, or error-free. Drug information on our platform — dosages, indications, interactions — is for general reference. It's not a substitute for your doctor or pharmacist's advice, and we can't guarantee it's always complete or current.

Any material or data downloaded or otherwise obtained through our platform is done at your own discretion and risk, and you will be solely responsible for any damage to your device or loss of data that results from such download.

16. Our liability

To the extent permitted by law, eViRis Health is not liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Any loss of profits, data, business, or goodwill.
  • Any damages arising from your use of, or inability to use, our services.
  • Actions or omissions of third-party service providers accessed through our platform.

Where liability cannot be excluded by law, our total liability to you for any claim arising from your use of our services will not exceed the amount you paid to eViRis Health for the specific transaction giving rise to the claim, or ₹1,000 (Indian Rupees one thousand), whichever is higher.

We are not responsible for non-performance or breach of any contract entered into between you and third-party service providers, nor do we guarantee that any such provider will perform a transaction concluded on our platform. Nothing in these Terms limits any rights you may have under the Consumer Protection Act, 2019 or any other mandatory consumer protection legislation applicable to you.

17. Indemnity

You agree to indemnify and hold harmless eViRis Health, its affiliates, directors, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your misuse of the platform, violation of these Terms, infringement of any third-party rights, or any breach of the representations, warranties, covenants, or agreements made by you under these Terms.

18. Regulatory compliance

eViRis Health and its service partners operate in compliance with applicable Indian laws and regulations, including:

  • Drugs and Cosmetics Act, 1940 and Rules, 1945
    Governs the sale, stocking, and dispensing of medicines, including Schedule H, H1, and X drugs.
  • Pharmacy Act, 1948
    Requires all dispensing to be performed by registered pharmacists holding valid licences.
  • Narcotic Drugs and Psychotropic Substances Act, 1985
    Prohibits the availability of Schedule X and other regulated narcotic/psychotropic substances through our platform.
  • Consumer Protection Act, 2019 and E-Commerce Rules, 2020
    Protects your rights as a consumer, including your right to approach consumer dispute redressal forums.
  • Information Technology Act, 2000 and Intermediary Guidelines Rules, 2021
    Governs our obligations as an online intermediary, including publication of these Terms.
  • Digital Personal Data Protection Act, 2023
    Governs how we collect, process, and protect your personal data, as set out in our Privacy Policy.

Nothing in these Terms limits any rights you may have under the Consumer Protection Act, 2019 or any other mandatory consumer protection legislation applicable to you.

19. Suspending or closing access

If we have reasonable grounds to believe an account is being misused, involved in fraud, or violating these Terms, we may restrict or close access — temporarily or permanently, with or without prior notice. We don't take this lightly, and we'll act only when there's a genuine reason.

We may also terminate or suspend access if required by law, if providing services becomes unlawful, or if we elect to discontinue a service for valid business, operational, or legal reasons. You may stop using our services at any time by simply not accessing the platform, or by closing your account where that option is available. Upon termination, access to all offerings may be removed and materials associated with your account may be deleted.

20. Communications

By using our platform, you agree to receive communications from us by way of SMS, email, WhatsApp, or phone calls relating to your orders, appointments, test results, and the services offered through our platform. Transactional messages — order confirmations, delivery updates, appointment reminders — are necessary for us to deliver the service you've asked for.

For marketing messages, you can opt out at any time. To stop WhatsApp messages, send "STOP" to our WhatsApp number. To opt out of SMS marketing, reply "STOP" to any message, or register on the national DND registry via the TRAI DND app or by calling 1909. You can unsubscribe from marketing emails by clicking the unsubscribe link at the bottom of any newsletter. Opting out of marketing messages won't affect the transactional updates you need.

21. Changes to these Terms

We may update these Terms from time to time. When we make significant changes, we'll let you know by posting a notice on our website or sending you an email. Changes are effective immediately upon posting the revisions on our website. We will inform you of such changes within the timelines required under applicable law. Continuing to use our services after those changes means you accept the updated Terms, so please review these Terms periodically.

22. Governing law & dispute resolution

These Terms are governed by the laws of India, without reference to conflict of laws principles. The courts at Hyderabad, Telangana shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms — subject to any mandatory dispute resolution process required by applicable law, including your right to approach consumer dispute redressal forums under the Consumer Protection Act, 2019.

23. Force majeure

eViRis Health shall not be liable for failure or delay in performance caused by events beyond reasonable control, including natural disasters, pandemics, government actions, network failures, labour disruptions, or other force majeure events.

24. General provisions

Notice

All notices from eViRis Health will be served by email or by a general notification on our website. Notices to us should be sent to our legal contact email.

Assignment

You cannot assign or transfer these Terms, or any rights granted under them, to any third party. eViRis Health's rights under these Terms are freely transferable by us without requiring your consent.

Waiver

Any failure by us to enforce or exercise any provision of these Terms, or any related right, does not constitute a waiver of that provision or right.

Severability

If any part of these Terms turns out to be invalid or unenforceable, that part will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.

Survival

Sections that should logically outlast the relationship — like liability, indemnity, intellectual property, and governing law — remain in effect even if you stop using eViRis Health.

25. Grievance & contact

If you come across any abuse or violation of these Terms, or if you have a concern or grievance about our services, please contact us with a thorough description and we will try to resolve the issue for you. We'll acknowledge your complaint within 72 hours and work toward a resolution within 30 days, as required under the Consumer Protection (E-Commerce) Rules, 2020.
